Earlier this week, the Department of Education’s Office for Civil Rights published a letter affirming its position that biological males should not be allowed to compete against female student-athletes under Title IX. The letter defended this position as fully in line with the Supreme Court’s recent ruling in Bostock v. Clayton County:

 

After reviewing Bostock, the Office for Civil Rights concurs…that the Bostock holding does not alter the legal authority for sex-segregated teams under Title IX. Even if Bostock applied to Title IX—a question the Supreme Court expressly declined to address—its reasoning would only confirm that Title IX does not permit a biologically male student to compete against females on a sex-segregated team or in a sex-segregated league.

 

In response to the letter, Terry Schilling, executive director of American Principles Project, praised the administration for its continued defense of women’s sports:

 

It should now be clear, if it wasn’t already, that women and girl athletes nationwide have no greater champion than President Trump.

 

Since the Supreme Court’s terrible Bostock ruling earlier this year, radical leftist groups have been busy trying to exploit it to advance the most extreme elements of their agenda, including destroying women’s athletics. The pressure on government officials to surrender to this agenda has been enormous.

 

But fortunately, the President recognizes this is a fight too important to surrender. We join with countless Americans in thanking the Trump administration for standing strong in defense of a fair playing field for women and girl athletes, and we look forward to continuing to support them in this critical effort.
