A bill to define basic biological terms as well as remove gender identity as a protected class been filed in the Iowa House of Representatives. House Study Bil 242 is a committee bill from Judiciary Committee Chairman Steve Holt.
The bill would define the term “sex” as being either male or female as observed or clinically verified at birth.
The bill would define the term “female” as an individual who has, had, will have through the course of normal development, or would have but for a developmental anomaly, genetic anomaly, or accident, a reproductive system that at some point produces ova.
The bill would define the term “male” as an individual who has, had, will have through the course of normal development, or would have but for a developmental anomaly, genetic anomaly, or accident, a reproductive system that at some point produces sperm.
The bill defines “woman” or “girl” as female. The term “man” or “boy” refers to a male.
The bill defines “mother” to mean a parent who is female and the term “father” as a parent who is male.
The bill makes the term “gender” a synonym for sex and will not be considered a synonym or shorthand expression for “gender identity, experienced gender, gender expression or gender role.”
The bill also states that separate accommodations are not inherently unequal and that the term equal does not mean same or identical.
The bill removes gender identity as a protected class for the purposes of Code chapter 216. It also removes gender identity as a protected class in the prohibition of discrimination under federal, state and local law for charter schools and innovation schools.
The bill also replaces the term “gender identity” with the term “gender theory” and defines “gender theory” as it relates to current Code section 279.80.
