Liberty Counsel Action chairman Mat Staver has highlighted four reasons impeachment of President Donald J. Trump is wrong.
Supreme Court Chief Justice John Roberts has already refused to preside over the trial. Article 1, Section 3 of the U.S. Constitution states plainly that the Chief Justice shall preside over the impeachment trial in the Senate.
Rather, Vermont Democrat Sen. Patrick Leahy will serve as the judge. Leahy has already voted to impeach Trump once, which would seem to indicate anything but an impartial judge.
“This is a sham akin to a repressive regime,” Staver said.
Impeachment, he said, is only for the removal of a person from office.
“The Senate has no authority to convict a private citizen,” Staver wrote. “Left unchecked, any majority party could impeach any private citizen and thereby ban them from ever running for office.”
It is also divisive and being used to silence those opposed to socialism. Staver said there was zero due process in the House as the House impeachment included no witness, no evidence and no defense.
“This is reminiscent of the Russian Gulag,” Staver wrote. “A process intentionally void of any due process.”
And, as mentioned earlier, only the Chief Justice can preside over the Senate trial.
“This process is a complete repudiation of everything our nation was founded upon,” Staver said. “And it is just a stepping-stone from Trump to silencing you.”
