Unless Iowa Senate Republicans are willing to get creative, nothing will be done to resist the use of eminent domain to complete the Carbon Capture Pipelines in Iowa this legislative session.
According to Republican Sen. Mike Bousselot, who was assigned as subcommittee chair of House File 565 in the Senate, the bill will not advance.
The proposal requires 90 percent of impacted landowners to voluntarily allow the pipeline to be constructed on their land before a pipeline company can seek eminent domain.
This week marks the “second funnel” deadline in the legislature — meaning a bill must pass through one chamber and advance through committee in the other to be considered.
House File 565 was referred to the Senate Commerce Committee, which is chaired by Republican Sen. Waylon Brown.
There are tactics and tools that can be utilized by legislators or leadership if they believe protecting the private property rights of Iowans are important enough to force a vote.
