Amid the crisis at the border, U.S. Citizenship and Immigration Services is taking action on one thing…

Form N-400 has been revised to provide a third gender option, “X,” which is defined as “another gender identity.”

Guidance is being updated in the USCIS Policy Manual to account for the form revision and other forthcoming form revisions that will add a third-gender option.

The April 1, 2024 edition of Form N-400 will be the first USCIS form to include the “X” gender option.

No supporting documentation is needed to select “X” as a person’s gender. The gender one selects does not need to match the gender listed on other immigration documents or on supporting identity documents either, such as a birth certificate, passport or state identification.

According to a release, historically listing male and female as the only gender options has created “significant barriers” for those who do not identify with either of the genders. Ironically, the release states…

“Adding a third gender option helps ensure that secure identity documents and biographical data are accurate and helps both external stakeholders and individuals requesting immigration benefits.”
