On Tuesday, America First Legal (AFL) launched an investigation into the Biden-Harris Department of Justice (DOJ) and Federal Bureau of Investigation (FBI) to obtain all communications from Special Counsel Jack Smith’s Office during the unprecedented, politically motivated investigation against President Trump.

Recent reports have raised further serious questions about the integrity of the Department of Justice and Special Counsel Smith’s investigation into President Trump. Former senior Department of Justice officials expressed concern that Special Counsel Smith’s team is coordinating directly with Vice President Harris’ presidential campaign. These reports are deeply troubling and warrant investigation.

Accordingly, AFL has filed Freedom of Information Act (FOIA) requests for all government phone records of individuals working in Special Counsel Smith’s Office, including communications and calendar items, throughout their investigation of President Trump.

Members of Special Counsel Smith’s team must retain all relevant records to ensure public accountability and transparency regarding the integrity of the Department’s investigation into President Trump.

Multiple members of Special Counsel Mueller’s team apparently “wiped” their cellphones after the Inspector General began his inquiry into how the Department mishandled Crossfire Hurricane. Federal law requires the preservation of all records related to the Special Counsel’s investigation and prohibits the disposal or destruction of records that are the subject of a FOIA request, appeal, or lawsuit.
