A U.S. District Judge vacated President Joe Biden’s national COVID mask mandate for planes and other forms of public transportation on Monday.

Federal judge Kathryn Kimball Mizelle, an appointee of President Donald J. Trump, ruled the CEDC had overstepped its authority.

The TSA would not enforce the mask mandate on public transportation after the ruling, according to a Biden administration official.

Press Secretary Jen Psaki said the administration is still reviewing the ruling and the Department of Justice will decide whether to file an appeal.

Less than a week ago the CDC extended the mask mandate for 15 days.
