SCOTUS Should Hold FDA’s Abortion Pill Expansion Unlawful and Apply Existing Federal Law Banning Abortion Pill Trafficking

Lila Rose, founder and president of Live Action, released the following statement in anticipation of oral arguments in front of the Supreme Court in the case of Alliance for Hippocratic Medicine (AHM) v. Food and Drug Administration (FDA). 

The abortion pill, mifepristone, has killed millions of American children. Mifepristone (also known as RU-486) blocks the action of the hormone progesterone, which is naturally produced by the mother’s body to enable the mother to sustain and nourish the pregnancy. When RU-486 blocks progesterone, the lining of the mother’s uterus breaks down, cutting off blood and nourishment to the baby, who then dies inside the mother’s womb. This ongoing crime has been approved and is now being encouraged by our federal government.

The FDA, the government agency responsible for safeguarding public health, has let down women and girls by abandoning safety protocols and endorsing DIY abortions without ongoing medical oversight. What’s worse, the FDA made these decisions despite information on the drug’s label indicating that between 2.9% and 4.6% of women who take the drug may require emergency room treatment; based on this data, the Alliance for Hippocratic Medicine has estimated that roughly 1 in 25 women who take mifepristone may require emergency care.

Women need ongoing medical support when dealing with high-risk drugs, and the U.S. Supreme Court should uphold the 5th Circuit’s judgment, which holds the FDA accountable for its unlawful failure to protect the health and safety of women and girls. By recklessly removing in-person visits during which blood work could be performed, dangerous ectopic pregnancies could be ruled out, and gestational age could be verified, women may be suffering unnecessary complications and potentially life-threatening infections. The FDA should never have approved this drug to begin with, as its only intended use is to kill a human being.

Federal law currently prohibits sending abortion drugs through the mail. Because the FDA’s abortion-drug regulations are unlawful under the Comstock Act, the Supreme Court must stop the Biden Administration’s abortion pill trafficking.
