Each elected official in the State of Iowa swears an oath to uphold the constitution of the state. With this in mind, the Republicans of Black Hawk County on Thursday, April 16, 2020 passed the following resolution:
“Be it resolved that the express position of the Republicans of Black Hawk County is that neither the Office of the Governor, nor its authorized delegates, shall make any legally enforceable decree abridging the enumerated Constitutional right of the people to peaceably assemble.”1-2
Iowa Code Chapter 29C Emergency Management and Security specifically details the powers granted by the Legislature to the Office of the Governor during a state of emergency. Of these codified powers, the suspension of Article 1. Sec. 20 in the Iowa Bill of Rights is not among them.
We as the Republicans of Black Hawk County, support the U.S. Constitution and the Constitution of the State of Iowa.
