Congressman Michael Cloud (TX-27), Senator Ted Cruz (R-TX), and State Representative Stan Gerdes (HD-17) are demanding immediate answers from Immigration and Customs Enforcement (ICE) following reports that an American citizen was killed by an illegal immigrant driving under the influence in Bastrop County. The suspect, who had been deported twice before, was able to illegally re-enter the country under the Biden-Harris Administration and is now responsible for yet another preventable tragedy.
Bastrop County Sheriff Maurice Cook confirmed that his office reported the individual to ICE following the crash, and ICE placed a hold on the suspect. “When ICE puts a hold on someone, it’s because that person is an illegal immigrant and they have an interest in them,” Sheriff Cook said. ICE typically only places holds on undocumented individuals, indicating that federal authorities were aware of the suspect’s illegal status before this incident occurred.
Our offices have also learned that the suspect was previously deported twice—once under the Obama Administration and again under the Trump Administration after being arrested for driving under the influence. However, in 2021, under the Biden-Harris Administration, the suspect illegally re-entered the country and last week killed an American citizen in Bastrop County, Texas while again driving under the influence.
Congressman Cloud, Senator Cruz, and State Rep. Gerdes are demanding answers from ICE and the Biden Administration, including:
- How did the suspect re-enter the country illegally after being deported twice?
- Did immigration authorities know the suspect was residing in the country prior to this incident?
- What gaps in enforcement allowed the suspect to evade detection and remain in the U.S. after prior deportations?
Rep. Cloud released the following statement: “Another family’s worst nightmare has come to pass, and it’s directly because of the Biden-Harris Administration’s reckless, open-border policies. Their refusal to enforce our immigration laws has taken another innocent life. How many American citizens have to be killed by illegal immigrants before Joe Biden and Kamala Harris decide to act?”
Senator Cruz released the following statement: “Yet another Texan is dead directly because of the Biden-Harris border crisis. Texans deserve answers about why this illegal alien was allowed back into our country after being deported twice. This crime was both infuriating and avoidable, but the Biden-Harris administration has made a cynical decision to keep the border open for political purposes. The resulting crimes are avoidable, infuriating, and unacceptable.”
Texas State Rep. Gerdes released the following statement: “What happened to Grayson Davis and his grieving family was completely avoidable. Our entire community is heartbroken. The failure of the Biden-Harris administration on our southern border has cost countless lives. While Senator Cruz and Congressman Cloud carry on the fight at the federal level, I will be filing legislation this coming session, “Grayson’s Law,” that addresses illegal immigrant crime at the state level.”
Congressman Cloud, Senator Cruz, and State Rep. Gerdes will continue pushing for a full investigation into the suspect’s immigration history and demanding that ICE and federal authorities provide clear answers on how this tragedy was allowed to happen and what changes are being made.
