This week, America First Legal (AFL) continued its crucial fight in a case pending at the U.S. Court of Appeals for the District of Columbia Circuit, stemming from its lawsuit against fourteen federal agencies for concealing their “Strategic Plans” for implementing President Biden’s executive order directing them to interfere in elections.

President Biden’s Executive Order 14019, “Promoting Access to Voting,” called for each agency to submit to a “Strategic Plan” for using social media companies to promote mail-in voting schemes, expanding “multilingual voter registration and election information”; and using federal agencies for distributing voter registration and mail-in ballots, “soliciting and facilitating approved, nonpartisan third-party organizations and State officials” to provide voter registration services on agency premises, and “assisting” voters “in completing voter registration and vote-by-mail ballot application forms.” The Biden Administration has hid its plans from Congress and the public, but what has been revealed so far has been troubling.

At the district court, AFL argued that the Presidential Communications Privilege does not cover the agencies’ Strategic Plans because they were not solicited to advise presidential decision-making. However, the district court judge relied on a declaration signed by Richard A. Sauber, Special Counsel to President Biden, and allowed the Biden Administration to conceal the agencies’ Strategic Plans under the Presidential Communications Privilege merely “because the strategic plans were solicited by President Biden through EO 14019 and received by his immediate White House advisors for use in briefing and advising him on voting rights issues.”

Now on appeal, AFL filed a critical brief outlining why the district court’s decision was incorrect, and explaining why the records must be released for the American people to review.

The Biden administration has launched an unprecedented election interference program through the federal government’s agencies, and it continues to conceal its plans through an unlawful invocation of Executive Privilege. AFL is absolutely committed to exposing the government’s scheme to rig the next election using taxpayer resources and to prolong the current leftist dystopia.
