Yes, Senator Alons our freedom is in peril, due to our state leaders inaction:

Senator Alons expounds on the frustration many of us feel about the Federal Government, He gives you fear after fear and tells you that our elected leaders and federal workers have no regard for the constitution that they are obligated to adhere to. He reminds you they all took an oath including himself to obey and defend the Constitution. He states that they have overstepped and are willfully not following the constitution when it comes to the enumerated powers which in the original constitution are limited and few. If he truly believes they are acting outside the constitution, would not a simple person like me conclude they are breaking the Law?  After all the Constitution is the highest law of the land. If anyone is drawing money from the treasury without the proper authorization, aren’t they committing Fraud and Theft? Anyone receiving illicit money would then be coconspirators to fraud and theft. It should appear to him and anyone else that they could be criminals.  Senator Alons is a duly sworn state senator charged with defending the Constitution of the United States. So, what is he doing about it?

First, we must examine who is it that is committing these criminal activities. Based on his rhetoric of specific enumerated and narrow things the federal government could do. Specifically in Article 1 section 8 you do not find education, department of Agriculture, CDC, health care, EPA, social security. If Senator Alons is correct in his assertion, then any money drawn from the treasury for any of these would be fraud and theft.  The people drawing money without constitutional authorization should be charged. Also, anyone receiving this money from this illicit activity is a coconspirator and should be charged. Look at it this way, if I drew money from my sister’s bank account without proper authorization, I would have committed theft and fraud. If I buy you a new car with that illicit money, you could be a coconspirator in this criminal activity or at the very least be required to return the car and make my sister whole. Under Senator Alons’ premise, it would seem to me that most of us have committed theft and fraud and certainly most of our state officials since they accept education and healthcare money from the federal government. All social security money should be repaid. All farm subsidies. As Senator Alons says everyone who swears an oath to the Constitution and is elected has the duty to defend the Constitution and uphold the law. So shouldn’t Senator Alons be asking the county, state and district attorneys to start prosecuting people? Maybe he should start with most of the state officials by referring them for prosecution. After all the state receives enormous amounts of funds from the federal government for health care and education. Maybe he should author legislation to return these illicit funds received by the State of Iowa to the US treasury.  He could call on the farmers in his district to take a plea deal and sell off their land to repay any farm subsidies and grants that they received from this illicit money drawn from the US treasury without proper constitutional authority.

The facts of the matter would show Senator Alons is wrong and misleading in his assertion that the Federal Government does not follow the Constitution. They in fact have the authority to do almost everything they do. The framers of the Constitution in Article III gave the power to solve disputes to the judicial branch. When they solve disputes that arise out of executing the laws then the resolution of that dispute becomes part of the Law and or the constitution. They call it The US Constitution Annotated, analysis and interpretation. The Constitution gives this authority to the Judicial Branch and that is why court decisions become so important. Our current Constitution is nearly 3,000 pages long. Our elected officials could get a copy of this Annotated Constitution when they take office. My fellow citizens it is not that they do not have the authority, but that they have been given the authority to exceed the original intent of the framers by the Supreme Court. Specifically in decisions about the general welfare clause which is in Article I section 8 of the constitution, or the commerce clause. The Supreme Court rulings in these areas have enabled the Federal Government to be involved and draw money to enact their policies in almost every area of our life. Now in 2023 the general welfare encompasses almost everything except what the Government is limited to in the bill of rights. With the Kelo decision in 2005 the Supreme Court gave all governments more authority for use of eminent domain beyond the framer’s intent. It is not that the government is acting unconstitutionally it is that as of now the Supreme Court has allowed it as constitutional.  The framers intended for the Federal Government to be limited, but with these Supreme Court rulings they have become overbearing, oppressive, and infringing on our liberties. It seems that the common citizen understands the system is broken and needs repair. This is where our frustration lies. It is not that they do not obey the constitution is that our elected leaders no longer address our grievances or refuse to fulfill their constitutional responsibility.

We must understand that the State created the Federal Government and all power given to them comes from the people and the States collectively. In simple terms the States are the parent and the federal government is the child. The states have always had the power to come together and put limits on the Federal Government. If a parent gives a child a debit card and says you can only use this for books and tuition and the child then goes out and buys gifts for his friends, goes to movies, and ends up spending all the money in the bank account, the Parent then instead of taking away the card or disciplining them adds more money to the account. When that runs out having no more of their own, they get a credit card, and they give that card to the child. All the while they decry to their neighbors and friends that the child is out of control, and they might not be able to make their mortgage payment. They blame the school, the child’s friends, their neighbors and say there is nothing they can do. They say you can help save their child by using this scheme I found to produce our own currency or a host of other solutions that will help them as they decry the actions of their child. Calling on us to help them enable their child’s bad behavior.

Let’s be clear on this… Your state legislators and specifically your representatives and senators have the power to put limits on this child (Federal Government). They have always had this power under Article V of the Constitution (a convention of states). The very Article in the Constitution Senator Alons fears most. Under our constitution they have the duty to impose limits when the federal government oversteps it bounds. Most of grievances that we all take to our elected officials could be solved with a convention of states call that would limit the federal government including the Judicial Branch and eminent domain. Should we cast all the blame on the child when the parent refuses to discipline the child? Who has the greater responsibility? I submit to you that our very freedom is in peril because our state legislators fear and fail to do their duty. If you are frustrated and angry at the Federal Government first look to the Parent (the state legislatures) and ask them to impose limits and quit enabling them. If you allow your representatives to blame others for their fear and inaction or allow them to make you too fearful to act shame on you! Your fear is what the enemy prizes most because you will cower into inaction.

Senator Alons, I respectfully ask you to uphold your oath and constitutional responsibility and support the Convention of States application to limit the power and scope of the federal government. In doing so we have the best chance to save the Republic and preserve our freedom you fear is in peril.
