Liberty Counsel filed an amicus brief at the Kentucky Supreme Court on behalf of the National Hispanic Christian Leadership Conference (NHCLC) and the Frederick Douglass Foundation in defense of the state’s numerous state pro-life laws by arguing that the Kentucky Constitution protects life and not abortion.
This broad group of African Americans and Hispanics represent tens of millions of constituents. These minority communities have been the direct target of abortion, and most Planned Parenthood’s abortion clinics are located in black and Hispanic neighborhoods. Liberty Counsel also filed an amicus brief on behalf of the NHCLC and the Frederick Douglas Foundation at the U.S. Supreme Court in the Dobbs abortion case. In overturning Roe v. Wade and Planned Parenthood v. Casey, the High Court cited to this brief acknowledging that abortion has disproportionally impacted the black community.
NHCLC is the largest Hispanic church association in America with more than 42,000 churches. NHCLC President/CEO Rev. Samuel Rodriguez said, “We saw the post-Roegeneration was inevitable. Americans’ opinions were changing, and it seemed to accelerate that more Latinos became engaged in the public square. The pro-abortion lobby, and the politicians beholden to them, didn’t see the sands of public opinion were shifting under their feet. Eventually, a vast majority of Americans wanted some restrictions on abortion, and they wanted to leave it to their states to decide. The truth is that I was the last person surprised by Dobbs. I was just surprised it took so long.”
Liberty Counsel’s amicus brief in Daniel Cameron in his official capacity as Attorney General of the Commonwealth of Kentucky v. EMW Women’s Surgical Center, P.S.C., et al. emphasizes “the eugenics-based abortion industry denies the fact that each human being has inherent value and dignity that is bestowed on them by their Creator. Instead, it leaves to government decision-makers the determination of when or if human life has worth and value.”
Planned Parenthood’s founder, Margaret Sanger, believed that the “unfit” and “feeble-minded” were a menace to society and that these “undesirable” people should not reproduce and thus advocated for their sterilization.
Liberty Counsel’s amicus brief states that, “Prohibiting abortions protects all developing human beings from racially motivated termination while in the womb. As Justice Thomas noted, today’s ‘[t]echnological advances have only heightened the eugenic potential for abortion, as abortion can now be used to eliminate children with unwanted characteristics, such as a particular sex or disability.’ Thus, abortion may now be used as ‘a disturbingly effective tool for implementing the discriminatory preferences that undergird eugenics.’ For that reason, Kentucky has a compelling interest in ‘preventing abortion from becoming a tool of modern-day eugenics.’”
In addition, “The racial disparity in abortions is largely intentional: A study based on 2010 Census data shows that nearly eight out of ten Planned Parenthood abortion clinics are within walking distance of predominantly Black or Hispanic neighborhoods. More specifically, Planned Parenthood intentionally located 86 percent of its abortion facilities in or near minority neighborhoods in the U.S. counties with the most abortions. These 25 counties contain 19 percent of the U.S. population, including 28 percent of the Black population and 37 percent of the Hispanic/Latino population. In 12 of these counties, Blacks and Hispanics/Latinos are more than 50 percent of the population. In contrast, Blacks are only 12.6 percent of the U.S. population, and Hispanics and Latinos are 16.3 percent. Planned Parenthood’s largest abortion facility in America is situated in the middle of a Black and Hispanic neighborhood within walking distance of a nearby school. Given that Planned Parenthood has strategically located abortion clinics near minority neighborhoods, the abortion industry’s attempt to deny its eugenic aims cannot withstand objective scrutiny.”
